Privacy and terms

How SA DILAP handles personal information under the Protection of Personal Information Act (POPIA), and the terms that apply to our reports.

Privacy policy (POPIA)

  1. What we collect. Your name and contact details, the property or site address, and 360° photographs of it on the photo dates.
  2. Why. Only to make the photographs or virtual walkthrough you booked and deliver them to you. We do not use them for our own marketing without your permission, and we do not sell them.
  3. Signing in. When you open a report you sign in with an emailed code, or with your Google or work Microsoft account. We only receive your email address to check that you are on the list of people allowed to view that report. We never see your password.
  4. Who sees it. For dilapidation and progress photos, the people the client lists, and no one else without written permission unless the law requires it. A virtual walkthrough is shared by link with whoever the client chooses.
  5. Sensitive items. We avoid photographing alarm panels, safes, valuables, documents and family photographs where we can, and blur any that appear.
  6. How long. We keep the photographs and report for 5 years after the last visit, or longer if a claim is open. The online link closes 12 months after the final visit unless the client asks us to keep it open.
  7. Your rights. You may ask to see, correct or delete your information, or object to how we use it, by emailing bryan@sadilap.co.za. You may also complain to the Information Regulator (South Africa).

Terms of use of the report

  1. The report is a dated 360° photographic record of the visible condition on the photo dates. It is not a structural, engineering or defect assessment.
  2. You may view and use the report for the property named in it, including in any claim, insurance matter or dispute about the neighbouring works, and share it with your advisers, insurer, the developer and a court or tribunal for that purpose.
  3. SA DILAP owns the copyright in the photographs, the report and its software. You may not copy, alter, extract or reverse-engineer it, or use it to offer a similar service.
  4. We keep the original of every report with a digital fingerprint; if a copy does not match, the original prevails.
  5. SA DILAP is not liable for conditions that were hidden, inaccessible or not photographed. Our total liability is limited to the fee paid. South African law applies.
